We don't like writing terms and conditions, and we know you don't like reading them, but they're here for a reason, and that's to protect both you and Treeopia, so make yourself a cup of tea or coffee and take the time to read our small print.
It is important to us that you understand the terms on which we are making our agreement. Please read these terms carefully. These terms include important information on how we use the personal information that you provide to us.
How these terms & conditions apply to our contract
We consider these terms and conditions (the "Terms") and our price list to set out the entire agreement between you and us for the supply of our services to you. Only these Terms shall apply to our contract with you.
Please ensure that you read, understand and agree these ‘Terms and Conditions’ along with the ‘Book of Rules’ before you submit your Booking Request. You may only request a booking if you agree to these Terms and Conditions. By submitting a Booking Request, you are deemed to have accepted these Terms and Rules. This does not affect your statutory rights as a consumer.
Treeopia (referred to as Treeopia"/we/our/us") sells luxury treehouse holidays via www.treeopia.co.uk (the “Website”), via email requests and takes bookings direct at the treehouse site (the "Site"). Any person wishing to book a holiday via any of these methods (referred to as “you/your”) acknowledges that such booking is made subject to these Terms and Conditions.
We reserve the right to change these Terms and Conditions at any time. Any such changes will take effect immediately when posted on the Website, in the brochure, at the Sites, or otherwise brought to your attention. It is your responsibility to read the Terms and Rules each time you submit a Booking Request and any such request shall signify that you have accepted to be bound by the latest set of Terms and Conditions. A copy of the latest set of Terms and Conditions is available on the Website and upon request.
In addition to these Terms and Conditions, there is specific Book of Rules which apply, and a copy can be found in each treehouse.
Making a booking
When you wish to place a booking for a holiday (“Booking Request”) with us, you will complete a booking form (either on the Website, by email, or at the Site). It is your responsibility to provide us with the correct information. If you have made the Booking Request via the telephone. You will be responsible for the booking regardless of any input errors.
The Booking Request is an offer by you to enter into a binding contract with us and we are free to accept or decline your offer at our absolute discretion. We shall issue a written confirmation accepting your Booking Request. This written confirmation shall signify that we have accepted your Booking Request subject to these Terms and Conditions. At this point a contract shall come into existence between you and us on these Terms and House Rules.
By making a Booking Request you warrant that you and all guests are over 18, you have the authority of all persons in your party to book on their behalf, you accept these Terms and Conditions and you agree that you will be responsible for any loss or damage caused by you and any member of your party accompanying you.
The person making the booking must be responsible for all the guests in their party to read, understand and agree with the ‘Terms and Conditions along with the content of our Guest Book Information available in both treehouses.
Bookings and offers are not transferable to another party. Bookings are subject to minimum stay of two (2) nights in the week and three (3) nights at weekends.
Refunds cannot be given for any unused portion of a holiday due to curtailment.
From time to time, Treeopia may offer ‘Special Breaks’ starting on different days and / or differing duration’s, these Special Breaks are subject to these Terms unless we agree otherwise.
Car Scooter and Cycle Charging
No EV Car charging is permitted at either treehouse, the EV charging point in our yard must be used at all times.
Charging E cycles and scooters is not permitted at either treehouse, these must be charged in our yard, using the correct leads.
Mobile phones, tablets laptops and small devices
There are all permitted to be charged in the treehouse, using the correct charging lead for the device
Cleaning
You have our assurance Eathelin and Vivianna are vigorously cleaned between change overs and the hot tubs, emptied, cleaned and refilled with fresh water after each changeover.
All bedding, towels and robes are professionally laundered by a local company, where they are taking their own necessary precautions.
Age
We restrict Treeopia guests to adults only (over 18’s).
Pets
We pride ourselves in providing pet free accommodation, we have an ever increasing demand for this, due to fur allergies.
Prices
You will pay to us the price of your holiday as set out online at the time of your booking.
Prices include VAT at the current prevailing rate.
Prices do not include any additional services, features.
The maximum number of people occupying your accommodation must not exceed the number shown in the particulars of the treehouse - Bookings for both Eathelin and Vivianna must be for two guests only, no extra guests are to be added, this will infringe our insurance.
We ask guest not to invite others during their stay, larger parties can be noisy, causing disruption to the other treehouse guests looking for down time.
Price adjustments, promotions and discounted offers are introduced at the discretion of Treeopia. All promotions and offers are subject to availability, cannot be used in conjunction with any other promotion or discounted offer and may be withdrawn at any time. Retrospective refunds are not permitted against any price adjustment, promotion or discounted offer advertised after such time a booking is made.
Payment
To secure your booking, a non-refundable deposit of 30% of the total cost of your stay is required. You may also choose to pay the full balance at the time of booking.
Full payment is required at the time of booking if your stay is less than 30 days away.
The remaining balance must be paid in full at least 30 days before the start of your stay. You’ll receive an email with a payment link a few days before the balance is due.
If the balance is not paid by the due date, Treeopia reserves the right to re-let the treehouse and retain the deposit. It is the responsibility of the guest to ensure that any remaining balance is paid by the due date.
Prices are inclusive of VAT. We reserve the right to change our prices at any time.
No cheques are accepted by Treeopia.
Refund, cancellation & changes to your booking
No-shows
In the event of no-shows, we do not offer any (either full or partial) refund. We strongly recommend that you take out UK travel insurance when you make your booking.
Cancellation
Should you cancel your stay more than 30 days before the day of check in, we will retain the non-refundable booking deposit (or 30% of the total of your stay if you’ve already paid in full).
Should you cancel your stay within 30 days of the start date, the balance of your stay remains payable.
In the event of cancellation of your booking by Treeopia – for any on-site health and safety or quality-related issue (such as disruption to water supply) – you are entitled to a full refund of the money you have paid. You may also opt to change your booking to another date, subject to availability. Any additional cost relating to a change of dates would be payable.
Any liability arising from the cancellation of your stay by Treeopia, for whatever reason, is strictly limited to the total sum paid to us by you.
In the event that Treeopia is forced to close (e.g. due to a Coronavirus lockdown), you will be invited to choose new dates for your stay. Refunds will not be issued. (See Force Majure below.)
Booking Date Amendments
If the start of your stay is more than 30 days away, we will allow you to move your booking to an alternative date, subject to availability. Any additional cost relating to a change of dates would be payable. To request a date change, email info@treeopia.co.uk.
We will not move booking dates within 30 days of the start of your stay.
Force Majeure
Typical ‘Force Majeure’ events include, but are not limited to, pandemic, terrorism, serious crime, natural disaster, ‘Act of God’, government or public authority action or intervention, law, and travel restrictions.
If we are unable to offer accommodation due to circumstances beyond our control, we are not liable for refunds or expenses incurred. We recommend that you have adequate UK holiday insurance in place to cover this.
This means if we are prevented, hindered, or delayed from performing our obligations due to an event outside our control, including any action or order from the government, we will be relieved of our obligations. In the event of this happening, we will offer guests the opportunity to change the dates of their stay. We will not offer refunds.
Any deviation from these clear and express terms are entirely at the discretion of Treeopia, with the exception of subsequent local or national restrictions being imposed after the rebooking deadline, in which case the flexible rebooking policy would still be applied.
Occasionally we have to make changes to bookings. Whilst we endeavour to avoid making changes, we reserve the right to do so and no compensation is available.
We reserve the right to cancel your holiday. In the unlikely event of us having to cancel your holiday (except where you have failed to make full payment on time) we will offer you the choice of a full refund of all monies paid to us or the option of re-booking your holiday at a comparable standard (with you paying any additional cost or receiving a refund in respect to the price difference). No other compensation is available.
We strongly recommend that you take out cancellation insurance or check your annual travel insurance policy to cover any spent cost should you cancel for any reason outside your or our control.
Breakage cover
We do not add any breakage cover to our booking, all of our guests have been respectful, with just the odd broken glass.
Should you will be responsible for more serious damage, then Treeopia reserves the rights to recover these costs of all breakages/damage to our property from the guests.
We advise to purchase your travel insurance to ensure you are covered at checkout
Checking in & out
Check in is between 4pm and 8pm on the agreed date of arrival. If you are likely to arrive after 8pm, please let us know via telephone on 07971191201
Checking out is 10 am on your agreed date of departure.
Your responsibilities
The treehouse must be left in a clean and tidy condition. Please make Nicki or John Beavan are aware of any breakages or damage caused during your stay. Treeopia shall be entitled to charge you for any costs or expenses it incurs as a result of any breakage or damage or a failure by you to leave the treehouse in a clean and tidy condition.
The person booking is responsible for the behaviour of all members of your party. Please show consideration to other guests, Treeopia staff and our Site. Noisy or disruptive behaviour, especially at night, wilful damage to the Site or Treehouses or other behaviour considered by Treeopia staff to be inappropriate, may result in us asking you or a member of your party to leave the Site immediately. No refunds or compensation will be given in these instances, and we reserve the right to claim compensation for damages or inconvenience caused.
To respect the enjoyment of others, we ask that noise levels are kept to a minimum after 10pm. To protect our woods and surroundings, the burning of wood is strictly prohibited outside the designated area. Charcoal only BBQ's and a small fire pit are allowed, but only in the designated area, as set out in our Guest Book Information, available in each treehouse.
Open fires, swimming in ponds and rope swings, climbing trees or anything that may put you or others in danger or at risk are also prohibited, please stick to footpaths and do not walk along the edge of neither the pond nor the brook and keep within the boundaries which again are set out in ‘The Book of Rules’.
Please note that smoking or any naked flames are not permitted in any of the treehouses, BBQ’s and fire pits are only allowed in the designated areas please distinguish cigarettes thoroughly, fires are easily started in hot summers, please keep BBQ’s and fire pit fires small and manageable, please extinguish when leaving the area, if the fire/BBQ does not burn out itself, there is a bucket which can be filled with water to extinguish the fire.
Complaints
We want you to have an enjoyable Tree House holiday. Should you have cause for complaint, please contact Nicki Beavan immediately who will try to resolve your issue and advise you of our complaint’s procedure.
Information about you
We employ security measures to protect your personal information from access by unauthorised persons and against unlawful processing, accidental loss, destruction and damage. We may retain your personal information after we have ceased using it for the purposes set out in these Terms, or for as long as the law requires.
Natural inhabitants
Please note and remember that our treehouses are in a wood setting that is the natural habitat of a variety of native creatures such as snakes, insects, spiders, rodents and ticks. You should note any information and guidance provided in our Guest Book Information or notices available in both treehouses. As our treehouses are located in a wood environment, with ponds, we do not accept responsibility for any damage, injury or inconvenience caused by water, crops, plants, wildlife, flies or such like. Please always keep to paths and tracks and never wander from these.
Security of your property
We draw your special attention to the following:
Your personal belongings are your responsibility during your break with us.
Vehicles parked on our property are subject to very limited security cover only. You must lock your vehicle securely and remove all valuable items on parking.
We accept no liability for any accident, loss or damage to your property unless such loss, damage or accident is demonstrably due to our negligence or that of those for whom we are legally responsible.
We will offer reasonable help to assist you in tracing lost items.
We reserve the right to enter your accommodation at any time for any reasonable purpose, for example, to make checks, maintenance work or housekeeping. Your occupation is not exclusive.
The members of your party and the allocation of guests in each treehouse must remain the same for the whole of your stay.
The maximum number of guests in each treehouse (as stated on our website) must not be exceeded. If it is, we may move those additional persons to another accommodation unit and will charge you or them the appropriate full charge for the additional accommodation, from the date your party arrived for the break.
Wireless facilities
Wireless internet access, where available, is not guaranteed and is provided subject to third party terms and conditions which are available when accessing the system. The facility is not subject to any security/filtering measures.
We reserve the right to disclose your name and address to our internet service provider if we discover that you or a member of your party illegally downloaded content from the internet or otherwise engaged in unlawful activity whilst using this facility.
Guests are reminded that illegal file sharing is not permitted at this property and any violations will be the sole responsibility of the occupant.
Mobility requirements & special requests
We have one treehouse ‘partially’ adapted for use by our customers with mobility difficulties. Please make enquiries as to their suitability before booking.
Please note: Treeopia does not have the facilities for disposal of clinical waste.
We rely on the information you provide to help us anticipate and satisfy your needs. We therefore require you to update us with any change in circumstances prior to and during your stay.
If you have any medical problems or disability which may affect your stay you must advise us before booking giving full details to Nicki Beavan. Your booking may be declined or cancelled in your best interests if we feel unable to properly and safely accommodate your needs.
Hot tub use
Please note that in order to maintain the best levels of hygiene, our hot tubs are emptied, cleaned and refilled on departure of each booking, should there be a same day changeover then your hot tub may not be fully warm for comfortable use until the evening of your arrival.
Driving
At all times please give way to pedestrians and cyclists, keep to the left and within the 5-mph speed limit. Please use great care when driving. wildlife, logs and posts are placed to prevent damage to the roadsides and unauthorised driving and parking. No liability is accepted for any damage caused by these markers unless due to our negligence.
Dangerous items
Shotguns, knives, firearms, air weapons, archery equipment, Chinese lanterns, fireworks (including sparklers), illegal substances or similar items are strictly forbidden at Treeopia, breach of this policy may result in us asking you or a member of your party to leave the Site immediately. No refunds or compensation will be given in these instances, and we reserve the right to claim compensation for damages or inconvenience caused.
Noise
Military and other aircraft fly over our Villages, military manoeuvres can take place.
As a working farm, there will be cattle around, these are very docile and can moo!
There may be farming activities going on throughout the year, so tractors or other farming activities may be heard in the distance along with farm animals and wildlife.
There is at times maintenance carried out in the wood and around the treehouses, as this has to be done weather permitting, this can be during your stay, we will do our utmost not to inconvenience you.
You may experience noise from such activities from time-to-time. This is beyond our control.
Photography
Photography (still, digital and video) is not permitted of the other treehouse guests. Only non-intrusive photography of your own party and friends is permitted. You may not carry out photography for commercial purposes, publication or similar purposes in any part of Treeopia.
Treeopia does not accept responsibility for anything which adversely affects your holiday which is outside of our control. These circumstances are known as 'Force Majeure' events and are circumstances that Treeopia could not, even with due care, have foreseen or avoided. Such circumstances include (but are not limited to) war, civil unrest, industrial action, terrorist activity, natural disaster, fire, adverse weather conditions, pandemics, foot and mouth disease and all other similar events outside of our control. Treeopia will endeavour to manage any problems caused as a result of a Force Majeure event but shall be under no obligation to do so and shall not be liable to you for any losses caused by a Force Majeure event.
Reference to any products, services or other information belonging to third parties does not imply or constitute an endorsement, sponsorship or recommendation by Treeopia. Links to other services not operated by Treeopia are provided solely for your convenience. Treeopia accepts no liability for any products, services, or other information provided by third parties.
Termination of this contract
Either of us may terminate this contract at any time by providing the other party with 30 calendar days' prior notice in writing.
Termination will not affect either party's outstanding rights or duties, including our right to recover from you any money you owe us under these terms and conditions.
Other important information
Any photographs, descriptions or advertising we issue, and any descriptions or illustrations contained in our catalogues or brochures or on the Website, are issued or published solely to provide you with an approximate idea of our treehouses and the services. They do not form part of the contract between you and us.
If any court or competent authority decides that any of the provisions of these Terms are invalid, unlawful or unenforceable to any extent, the term will, to that extent only, be severed from the remaining terms, which will continue to be valid to the fullest extent permitted by law.
If we fail, at any time while these Terms are in force, to insist that you perform any of your obligations under these Terms, or if we do not exercise any of our rights or remedies under these Terms, that will not mean that we have waived such rights or remedies and will not mean that you do not have to comply with those obligations. Any waiver of a default by us does not mean that we will automatically waive any subsequent default by you. No waiver by us of any of these Terms shall be effective unless we expressly say that it is a waiver and we tell you so in writing.
A person who is not party to these Terms shall not have any rights under or in connection with them under the Contracts (Rights of Third Parties) Act 1999.
You may not transfer any of your rights or obligations under these Terms to another person without our prior written consent, which we will not withhold unreasonably. We can transfer all or any of our rights and obligations under these Terms to another organisation, but this will not affect your rights under these Terms.
These Terms and any non-contractual obligations relating to these Terms shall be governed by and interpreted in accordance with English law. You and we both agree to the exclusive jurisdiction of the English courts. This contract shall be concluded in the English language.

Liability
Please read this section as it is important that you understand what you are agreeing to: Nothing in this section limits or attempts to limit our liability for:
(a) death or personal injury caused by our negligence; or
(b) fraud or fraudulent misrepresentation; or
(c) any breach of the obligations implied by section 2 of the Supply of Goods and Services Act 1982; or
(d) losses for which it is prohibited by section 7 of the Consumer Protection Act 1987 to limit liability; or
(e) any other matter for which it would be illegal or unlawful for us to exclude or attempt to exclude our liability.
Subject to the matters detailed above, if we fail to comply with these Terms, we shall not be responsible for any losses that you suffer as a result, except for those losses which we could reasonably foresee would result from our failure to comply with these Terms.
In addition to above, we shall not be responsible for any:
(a) loss of income or revenue;
(b) loss of business;
(c) loss of anticipated savings; or
(d) loss of data.
Our maximum liability shall be no more than to refund the amount paid by you for the holiday.
